Counter-Notification Procedure

If material you have posted has been removed as a result of a DMCA notice and you believe the material was removed due to mistake or misidentification, you may submit a counter-notification containing the following information:

  1. Identification of removed material: Identify the material that has been removed and the location where it appeared before it was removed. Include the URL if possible.
  2. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Northern District of California if your address is outside the United States), and that you will accept service of process from the person who provided the DMCA notification or an agent of such person.
  4. Your physical or electronic signature.

DMCA Compliance Process

Upon receiving a valid DMCA notice, we will:

  1. Remove or disable access to the allegedly infringing content promptly.
  2. Notify the content provider of the removal and provide them with a copy of the DMCA notice.
  3. Provide information on how they can submit a counter-notification.

Upon receiving a valid counter-notification, we will:

  1. Provide the person who submitted the DMCA notice with a copy of the counter-notification.
  2. Inform them that we will restore the removed material in 10 business days unless they notify us that they have filed a court action seeking to restrain the allegedly infringing activity.
  3. Replace or re-enable access to the material between 10 and 14 business days after receipt of the counter-notice, unless we receive notice that a court action has been filed.

Repeat Infringer Policy

Bumbel maintains a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. A user may be considered a repeat infringer if we receive multiple DMCA notices identifying the user as responsible for infringing content. We determine, in our sole discretion, whether to terminate a user’s account based on the number and nature of DMCA notices we receive regarding that user.

Modifications to Content

We reserve the right to modify, remove, or disable access to any content that we believe to be infringing, whether or not we have received a DMCA notice regarding such content.

Good Faith Belief

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability.

Changes to This Policy

We may update this DMCA Policy from time to time. We will notify users of any material changes by posting the new policy on the site with a new effective date. We encourage you to periodically review this page for the latest information on our DMCA procedures.
